By accessing or using CleanPix ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

CleanPix is a photo enhancement service that allows users to upload, process, and enhance images using automated tools and artificial intelligence.

3. User Responsibilities and Content Liability

3.1 Your Content

You are solely and exclusively responsible for all content, including but not limited to photographs, images, and other materials ("User Content") that you upload, submit, post, or transmit through the Service.

3.2 Content Ownership and Rights

You represent and warrant that:

• You own or have all necessary rights, licenses, and permissions to upload and process your User Content
• Your User Content does not and will not infringe, violate, or misappropriate any third-party rights, including copyright, trademark, privacy, publicity, or other personal or proprietary rights
• You have obtained all necessary consents from any individuals depicted in your User Content

3.3 Prohibited Content

You agree that you will NOT upload, post, or transmit any User Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Contains child sexual abuse material (CSAM) or content exploiting minors in any way
• Depicts or promotes violence, terrorism, or harm to others
• Contains malware, viruses, or any malicious code
• Violates any local, state, national, or international law or regulation
• Infringes upon intellectual property rights of others
• Contains private or confidential information without authorization
• Constitutes or promotes spam, fraud, or deceptive practices

3.4 Platform Disclaimer

CleanPix does not pre-screen, monitor, or review User Content before it is uploaded or processed. You acknowledge and agree that CleanPix acts solely as a passive conduit for your content and bears no responsibility or liability for any User Content uploaded to or processed by the Service.

3.5 Content Removal and Account Termination

CleanPix reserves the right, but has no obligation, to:

• Remove or disable access to any User Content that violates these Terms or applicable law
• Terminate or suspend your account at any time, with or without notice, for any violation of these Terms
• Cooperate with law enforcement authorities regarding illegal content
• Report illegal content to appropriate authorities

4. Indemnification

You agree to indemnify, defend, and hold harmless CleanPix, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your User Content or your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

5. Intellectual Property

5.1 Your Rights

You retain all ownership rights to your User Content. By uploading User Content to CleanPix, you grant CleanPix a worldwide, non-exclusive, royalty-free license to use, store, process, and transmit your User Content solely for the purpose of providing the Service to you.

5.2 Our Rights

The Service, including its software, design, text, graphics, and other content (excluding User Content), is owned by CleanPix and is protected by copyright, trademark, and other intellectual property laws.

6. DMCA Copyright Policy

CleanPix respects the intellectual property rights of others and expects users to do the same. If you believe that your copyrighted work has been uploaded to our Service in a way that constitutes copyright infringement, please contact us with the following information:

• A physical or electronic signature of the copyright owner or authorized representative
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
• Your contact information, including address, telephone number, and email address
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEANPIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
• User Content or the defamatory, offensive, or illegal conduct of any third party
